Terms  and  Conditions

1. Services

We provide a range of services including but not limited to:

  • Fashion, Product, and Lifestyle Photography

  • Photography Art Direction

  • Social Media Design

  • Brand Identity Art Direction

The scope, timeline, and pricing for these services will be agreed upon prior to any project commencing, outlined in a written contract or proposal. All services are subject to availability and approval.

2. Booking & Payments

2.1. Booking

All bookings must be made through our contact form, email, or phone.

2.2. Payment Terms

Full payment is due upon completion of the project, unless otherwise agreed in writing. We accept bank transfer or PayPal. Failure to make timely payments may result in a delay or cancellation of services.

2.3. Cancellations & Rescheduling

Cancellations made less than 3 days before the scheduled project date may be subject to a cancellation fee. Rescheduling is subject to our availability and must be requested at least 7 days in advance.

3. Content Delivery

3.1. Proofs & Review

After the editing process is complete, clients will receive watermarked, low-resolution proofs for selection and review. These are intended for approval purposes only and are not to be used or shared publicly.

3.2. Final Image Delivery

Full-resolution, un-watermarked images will be delivered only after full payment of the final invoice has been received. Delivery will be via a Google drive link, or other agreed-upon method.

3.3. Image Format

Images will be delivered in JPEG format unless otherwise specified. RAW files are not included unless explicitly agreed upon.

4. Copyright & Usage Rights

3.1. Renewal

All usage rights are valid for a period of two (2) years from the date of licensing. After this period, clients must renew the license and make an additional payment to continue using the images.

3.2. Photographer’s Copyright

All images and creative works produced by Isobel Gill are the intellectual property of Isobel Gill unless otherwise agreed upon in writing. She retains full copyright ownership of all images, unless a buyout agreement is in place.

3.3. Client Usage Rights

Upon final payment, the client is granted a non-exclusive, non-transferable license to use the agreed-upon deliverables for the specific purposes outlined in the contract (e.g., marketing, social media, etc.). Additional usage beyond this scope requires written permission and may incur extra fees.

5. Art Direction and Brand Identity Services

5.1. Plagiarism & Intellectual Property

All concepts, ideas, and creative direction provided by Isobel Gill remain her intellectual property. Unauthorised reproduction, imitation, or plagiarism of these creative works is strictly prohibited.

5.2. Revisions

Any major revisions after final approval may incur additional fees.

6. Client Responsibilities

The client must provide all necessary materials, assets, and information required to complete the project in a timely manner. Any delays caused by the client may affect project deadlines and incur additional charges.

7. Confidentiality

We understand the importance of confidentiality in creative projects. Any client-provided materials, branding information, or sensitive business data will remain confidential and will not be shared with third parties without the client’s written consent.

8. Liability

We will not be held liable for any damages or losses resulting from the use of our services, including but not limited to financial losses, damage to reputation, or any unforeseen consequences. Our liability in any case will not exceed the total fee paid by the client for the project.

9. Revisions & Delivery

The number of revisions allowed will be clearly stated in the project proposal or contract. Additional revisions beyond the agreed-upon amount may incur extra costs. Final deliverables will be provided in the formats specified during the project planning stage.

10. Termination

We reserve the right to terminate a project or working relationship at any time due to breach of these terms, non-payment, or unprofessional conduct. In such cases, all work completed up to the point of termination will be invoiced, and any deposits will be forfeited.

11. Changes to Terms

We reserve the right to modify or update these Terms and Conditions at any time. Any changes will be posted on this page, and continued use of our services after such updates signifies your acceptance of the new terms.
